This can be a lengthy review so I'll keep it brief & provide the "need to knows". You need to know: The team is committed to you & your case. Although juggling multiple & various levels of difficulty, court cases, you area always made a priority and handled with the utmost care and respect. Frank is an amazing attorney and will fight for you tooth & nail. Once you two agree on a plan, he will run into a brick wall for you no matter who he has to combat. Frank will always shoot truth and never hype a situation to be what it isn't. I could say more and more, but I think you understand the drift. Not even a question, you should sign on & hire this family team. Frank will be family to me long after my case is resolved. That's the bond we've built. Not to mention, Frank's suit game is impeccable.”

Family Law Cases We Handle
We provide a comprehensive range of family law services, including:
- Divorce: Divorce may be uncontested or contested in cases where spouses cannot agree on key divorce issues, such as asset division or child custody, leading to court intervention for resolution.
- Uncontested divorce: A less adversarial process where both spouses agree on all aspects of the divorce, making court intervention unnecessary.
- Marital property division: Dividing marital assets and debts between spouses, typically following Idaho’s “community property” principle.
- Child custody and visitation: Determining children's living arrangements and visitation schedules in divorce, focusing on the child's best interests.
- Child support: Financial support paid by the noncustodial parent to the custodial parent to assist with the costs associated with raising the child.
- Alimony: Financial support paid by one spouse to the other after divorce, determined by factors such as the duration of the marriage, the age and health of the parties, and their financial resources and needs.
- Adoption: The legal process through which an adult becomes the legal parent of a child who is not biologically their own.
- Prenuptial agreements: Legal documents outlining the division of assets and spousal support in the event of a divorce or death, created before marriage.
- Modifications: Legal changes to court orders, such as child custody, visitation, or support, often due to significant changes in circumstances.
- Enforcement: Legal actions taken to ensure compliance with court orders, such as asset and debt division, payment of support, or visitation schedules.
- Paternity: Legal determination of a child's biological father, which can impact child custody, visitation, and support arrangements.
- Appeals: Legal proceedings challenging a lower court’s decision, seeking review and potential modification of the initial judgment.
Idaho’s Community Property Principle
Idaho courts follow the “community property” principle in deciding marital property division and alimony. This means that the court presumes that all assets and debts acquired during the marriage are considered community property and are divided equally between the spouses.
However, the court can deviate from this principle in certain circumstances. This is where a skilled and experienced family law attorney can be a great asset to you in a divorce.
Alimony/Spousal Support in Idaho
In determining alimony, the court considers several factors, such as the duration of the marriage, the age and health of the parties, their standard of living during the marriage, their financial or employment prospects, and their economic resources and needs.
Child-Related Issues in Divorce
In determining child-related issues such as custody, visitation, and support, whether during the divorce process or afterward, the court's primary basis is the child’s best interest. Factors such as the parent’s wishes, the child's wishes (if they are of a suitable age), the relationship of the child with each parent, the child’s adjustment to his or her home, school, and community, each parent’s character and circumstances, the need to promote continuity and stability in the child’s life, and whether there has been domestic violence in the home are considered in custody disputes.
Child Support
Idaho child support is a crucial component of family law, designed to ensure the financial well-being and stability of children following the separation or divorce of their parents. It fundamentally operates on the premise that both parents share the financial responsibility of raising their children. Importantly, child support is considered the child's right rather than the custodial parent's.
The determination of child support follows specific state guidelines. These guidelines consider several factors, including each parent’s income, the number of children, and the time each parent spends with the children. The aim is to provide a fair and equitable distribution of the financial burden, ensuring the child's needs are met without undue hardship to either parent.
While these guidelines are generally followed, the court may deviate under certain circumstances. For instance, if adhering strictly to the guidelines would lead to an unjust outcome or the child’s needs are exceptional (such as special medical or educational needs), the court may consider a deviation.
However, any deviation from the standard guidelines must be justified in writing by the court, emphasizing the child’s best interests above all.
Child support is not optional, and failure to meet this obligation can lead to serious legal consequences. At Gem State Family Law, we're dedicated to helping you navigate these complex issues, always putting your child’s best interests at the forefront.
